Delaware uses two different two-thirds formulas

Under Delaware Code §2324, temporary total disability is generally 66⅔% of the worker’s accepted average weekly wage, subject to the injury-date maximum and minimum. Section 2325 calculates temporary partial disability as 66⅔% of the difference between the preinjury wage and postinjury earning power, subject to the same maximum but not the TTD minimum.

Enter an AWW determined under §2302. It generally includes overtime, gratuities and regularly paid bonuses and uses a 26-week lookback, with separate methods for workers employed fewer than 26 weeks. The estimator does not determine which wage evidence should be accepted.

The TTD minimum cannot exceed the worker’s wages

Delaware has an explicit low-wage safeguard: if the employee’s weekly wage is below the statutory TTD minimum, the benefit equals the full weekly wage. For example, a $250 AWW in the current period produces $250—not the $320.91 minimum and not two-thirds. When AWW is at least the minimum but two-thirds falls below it, the statutory minimum applies.

TPD is different

TPD is based on actual loss of earning power. The calculator never forces the TTD minimum onto a partial-disability result, which could otherwise overstate the statutory formula.

The Code defines the maximum as 66⅔% and the minimum as 22 2/9% of the statewide AWW announced by the Secretary of Labor. The 2026 announcement is reproduced in the linked Delaware rate history; the percentages also reconcile to the published figures.

Cash disability generally begins on day four

Section 2321 provides compensation beginning with the fourth day of incapacity. If incapacity extends to seven days or more, including the injury day, compensation is payable from the first day. Medical care and specified permanent-injury benefits are payable from day one. This calculator estimates a weekly rate and does not count payable days.
