Maryland TTD and TPD formulas

Temporary total disability under Labor and Employment § 9-621 is two-thirds of the worker’s AWW, subject to the State AWW maximum and a $50 minimum. When the worker’s own AWW is below $50, the weekly benefit equals that AWW rather than $50.

Temporary partial disability under § 9-615 is 50% of the difference between pre-injury AWW and post-injury wage-earning capacity. Its separate ceiling is 50% of State AWW. Section 9-604 requires any fractional dollar in the compensation rate to be rounded to the next higher dollar.

The date of injury selects the State AWW used for the claim. The calculator does not replace an older injury-year maximum with the current rate.

AWW and wage-earning capacity need evidence

Maryland’s statutory AWW definition includes wages at the time of injury and can include tips plus the reasonable value of housing, lodging, meals, rent, and similar advantages. The Commission’s wage calculation and accepted records—not a single convenient paycheck—control the legal figure.

For TPD, actual post-injury earnings can be evidence of wage-earning capacity but are not always conclusive. Restrictions, offered work, job availability, skills, and other claim facts can matter. Enter an accepted figure or use the calculator to compare documented scenarios.

Waiting days and exclusions

If temporary total disability lasts 14 days or less, the first three calendar days are not wage-compensation days. If it lasts more than 14 days, compensation is allowed from the day disability began. Medical benefits are not withheld by this wage waiting period.

The estimate excludes payable-day counts, medical authorization, permanency, vocational rehabilitation, death benefits, offsets, credits, liens, concurrent-job issues, COLA, and settlement value. Read the Maryland claim guide for notice and filing steps.

Why does the calculator round upward?

Maryland § 9-604 requires a fractional dollar in the compensation rate to be rounded to the next higher dollar.

Can a worker with AWW below $50 receive $50?

No. The TTD statute says the benefit equals the worker’s AWW when that AWW is below $50.

Does the $50 minimum apply to TPD?

No. TPD uses 50% of the eligible wage difference and its own annual maximum.

Does the calculator value permanent disability?

No. Maryland permanent partial awards use separate tiers, impairment findings, weeks, and maximums.
