Benefit situation
For TPD, Montana limits the time-of-injury wage to a maximum of 40 hours a week.

Montana TTD pays two-thirds of injury-time wages

Temporary total disability generally pays 66⅔% of wages received at the time of injury, limited by the state average weekly wage for the injury period. The maximum is $1,137 for injuries through June 30, 2026 and $1,192 beginning July 1, 2026.

TTD66⅔% × accepted injury-time AWW, cappedTPDAWW − actual modified-work wages, capped by TTD rate

TTD eligibility also requires total wage loss supported by objective medical findings and can end at maximum healing or a qualifying release to work.

TPD does not use the usual two-thirds wage-loss formula

Montana’s temporary partial formula is an important exception. Before maximum healing, a worker with an approved physical restriction, modified or alternative work and an actual wage loss may receive the difference between the injury-time AWW and actual weekly wages, but never more than the worker’s TTD rate.

The pre-injury wage used for TPD is subject to a maximum of 40 hours per week. The calculator assumes the entered AWW already reflects the legally accepted amount; it cannot reconstruct hourly records or decide whether the restriction and wage loss qualify.

Waiting time and claim acceptance remain separate

Wage-loss compensation generally starts after the first 32 hours or four days of wage loss, whichever is less. If total disability lasts 21 days or longer, payment may become retroactive to the first day. The calculator estimates a weekly rate and does not count waiting hours or days.

Can TPD equal the full wage difference?

Yes, when the actual difference does not exceed the worker’s TTD rate and the other statutory requirements are satisfied.

Why is injury date required?

The official maximum is assigned by the July-to-June period in which the injury occurred.

Does this estimate PPD?

No. Permanent partial disability uses impairment and wage-loss rules after maximum healing and a different maximum.
