West Virginia Workers’ Compensation Calculator 2026
Estimate a standard temporary total disability rate with the official fiscal-year minimum and maximum.
Estimate standard TTD
Standard TTD is two-thirds of the accepted AWW
West Virginia Code §23-4-6 generally sets temporary total disability at 66⅔% of the worker’s average weekly wage at the date of injury. The standard result is subject to the minimum and maximum in effect on that injury date. The state rate sheet fixes the rate for the life of the award; later annual changes do not automatically raise an older claim.
The AWW itself can involve wage evidence and statutory selection rules. Enter the AWW accepted by the carrier, self-insured employer, Insurance Commissioner, or reviewing body rather than guessing from one paycheck.
West Virginia changes the maximum every July 1
| Injury period | TTD maximum | Standard minimum |
|---|---|---|
| Jul. 1–Dec. 31, 2026 | $1,150.91 | $193.33 |
| Jul. 1, 2025–Jun. 30, 2026 | $1,109.90 | $193.33 |
| Jul. 1, 2024–Jun. 30, 2025 | $1,067.12 | $193.33 |
| Jan. 1–Jun. 30, 2024 | $1,010.41 | $193.33 |
The minimum shown is the federal-minimum rate in the official WVOIC computation sheets. It does not replace the separate statutory treatment of part-time employment.
Part-time and rehabilitation cases require separate review
Part-time TTD uses §23-4-6d and may depend on scheduled hours and the federal minimum wage. Temporary partial rehabilitation under §23-4-9 is available only in an approved rehabilitation setting and uses a wage-loss formula. Neither route is silently treated as ordinary TTD here.
Why the confirmation box matters
A clean formula is useful only when it matches the benefit being estimated. If the worker was part-time or has returned under a rehabilitation plan, use the carrier’s calculation and the governing provision instead of this standard estimate.
Three waiting days can become payable
TTD generally requires more than three consecutive calendar days away from work. If disability lasts longer than seven days from the day the employee leaves work, compensation becomes payable for the first three days as well. The calculator estimates a weekly rate and does not count disability days.
