Oklahoma Workers’ Compensation Guide 2026
Understand notice, employer-directed medical care, temporary benefits, claim forms, hearings and filing periods.
Give the employer prompt notice and document it
Oklahoma law creates a rebuttable presumption against work relationship when the employee does not give oral or written notice within 30 days of an accidental injury. For occupational disease or cumulative trauma, a separate 30-day rule applies after separation from employment, and written-notice provisions can also apply. Report immediately, identify every affected body part, and preserve the date, recipient and delivery method.
The employer’s accident report and an employee’s claim filing are different steps. Keep photographs, witness names, schedule information, pay records, medical restrictions and every communication from the employer or carrier. Do not assume that medical authorization alone preserves a disputed claim indefinitely.
The employer generally selects and provides medical care
For a compensable injury, the employer normally controls the initial treating physician and must provide reasonable and necessary care promptly. WCC guidance states that treatment should be provided within five days after notice or knowledge. If the employer does not provide it, the worker may acquire rights to select care at the employer’s expense, but unauthorized treatment can create disputes.
A worker may request a one-time change of physician when the employer is not using a certified workplace medical plan or other special arrangement. The request ordinarily follows a filed claim and uses the Commission process. Emergency needs should be addressed immediately; routine changes should be documented rather than handled through unapproved self-referral.
Temporary disability replaces part of qualifying wage loss
TTD generally equals 70% of AWW up to the calendar-year maximum. For 2026 injuries, that ceiling is $1,128.66 per week. The first three days of the initial TTD period are not paid. The general TTD duration ceiling is 156 weeks, with a possible additional 52 weeks after the specific consequential-injury and medical findings required by section 45. Special limits can shorten benefits for soft-tissue injuries, hernias or mental injuries.
TPD uses 70% of the difference between pre-injury AWW and wages from alternative work. However, the post-injury wage must be below the TTD rate, and post-injury wages plus TPD cannot exceed the TTD rate. TPD is limited to 52 weeks.
A Commission claim begins with the correct CC-Form 3
The employee version depends on the claim: CC-Form 3 is used for an accidental injury, while specialized versions address occupational disease, death and other claim types. Filing the claim is not the same as requesting a hearing. A disputed issue may also require CC-Form 9 for a hearing or CC-Form 13 for a prehearing conference.
For an accidental injury, section 69 generally bars a claim unless it is filed within one year of injury or, when qualifying benefits have been issued for the injury, within six months after the last issuance. Occupational disease, cumulative trauma and death have different periods. Additional dismissal rules can apply when a filed claim is not actively pursued. Because timing turns on the benefit, exposure and payment history, use the current form instructions and do not postpone filing while negotiating informally.
Use the WCC Counselor Program and current forms
The Oklahoma Workers’ Compensation Commission provides a free Counselor/Ombudsman resource for process information to people who are not represented. Counselors cannot apply the law as personal legal advice. The Commission also publishes benefit charts, forms, process guides, mediation resources and governing documents.
Does fault decide whether workers’ compensation applies?
Workers’ compensation is generally a no-fault system, but the injury must still satisfy coverage and compensability requirements.
Who chooses the first doctor?
The employer generally controls the initial treating physician. Failure to provide qualifying care promptly can affect that control.
Does filing CC-Form 3 automatically request a hearing?
No. The WCC guide treats claim initiation and a request for hearing or prehearing conference as separate procedural steps.
